Biography

PETER MALYSHEV is a top-ranked regulatory lawyer, with three decades of experience advising financial institutions, market intermediaries, and commercial end users on complex regulatory, compliance, and transactional matters involving derivatives, commodities, securities, and emerging financial products. His practice focuses on the regulatory frameworks governing global derivatives markets, including oversight by the U.S. Commodity Futures Trading Commission (CFTC) and the U.S. Securities and Exchange Commission (SEC).

Peter is highly regarded by the industry and his clients for his regulatory knowledge and ability to apply it to business. He counsels U.S. and non-U.S. clients on both over-the-counter and exchange-traded derivatives across a wide range of asset classes. His work spans digital assets, interest rate and credit derivatives, foreign exchange, energy and environmental commodities, agricultural products, metals, and structured financial instruments. He regularly assists clients with the structuring and execution of sophisticated risk-management and hedging strategies, as well as the development of innovative financial products such as event and prediction contracts.

Peter has deep experience guiding clients through registration, compliance, and exemption issues under the Dodd-Frank Act and related CFTC and SEC regulations, including cross-border regulatory considerations. He advises a wide spectrum of market participants, including swap dealers, futures commission merchants, commodity pool operators and advisors, introducing brokers, trading platforms, and foreign intermediaries, as well as commercial firms using derivatives to manage business risk. His work also encompasses compliance with self-regulatory organization requirements and exchange rules in the United States and internationally.

Peter is consistently recognized by leading legal directories and industry publications for excellence in derivatives and futures law. From 2020 through 2025, he has been ranked a Band 1 lawyer by Chambers. He is ranked by Chambers USA (2013–2025) and Chambers Global (2015–2025) for Nationwide U.S. Derivatives, where he is described as “inquisitive and thorough as well. He takes critical eye to everything which is good” (2025).
