
Biography
AIMEE FAGAN is a first chair trial lawyer with a formidable track record of success managing high-stakes commercial, technology and IP litigation matters for leading companies from the energy, technology, investment/financial services, private equity, and medical industries, among others. She has considerable experience in both federal and state courts litigating a wide variety of issues including contract disputes, M&A acquisition disputes, IP disputes (including patent infringement, misappropriation of trade secrets, trademark disputes), enforcement of non-competes and non-disclosure agreements, indemnification disputes, disputes arising out of IP licenses/agreements, and investment disputes. She has also assisted in and advised on governmental investigations, IP transactions, and IP investments/acquisitions.
Aimee is ranked by Chambers USA in Texas in Intellectual Property, in which she is described as “a great strategic thinker with strong interpersonal skills who is able to translate the complex into the understandable” (2023–2025). Aimee was named “Litigator of the Year – Texas” and one of the “Top 250 Women in IP Litigation” by Managing IP (2024). She is recognized by The Best Lawyers in America® for Litigation — Intellectual Property (2026). She was also named a finalist for “Intellectual Property Attorney of the Year” by Texas Lawyer (2024). Representative Matters
Aimee’s more recent experience includes:
- Big Four Accounting Firm trade secret litigation – Won a motion to compel arbitration from the Eastern District of Texas in a case involving claims for trade secret misappropriation, in addition to other claims. Obtained a complete defense verdict on all counts after a week-long arbitration.
- Canatex Completions v. GR Energy, Wellmatics – After defeating a preliminary injunction on behalf of GR Energy and its affiliates in the Southern District of Texas, obtained a final judgment through claim construction proceedings that resulted in findings that all of the plaintiff’s patent claims were indefinite.
- Technology dispute litigation – Successful representation of technology company in federal court litigation involving contractual indemnification, misappropriation of trade secrets, and patent infringement.
- Legacy Separators and Guy Morrison, III v. Halliburton Energy Services, Inc., et al. – Won a take nothing verdict in favor of Halliburton in a three-week jury trial in Houston Federal Court in a theft of trade secret, fraud, and patent infringement case. The jury hung on two patent infringement issues − also in favor of Halliburton.
- Green Source v. Halliburton Energy Services, Inc. – Successful dismissal obtained for Halliburton in patent infringement suit in the Eastern District of Texas (Marshall Division, Judge Gilstrap presiding) related to use of terpenes in downhole stimulation and production.
- Adelos Inc. v. Halliburton Energy Services, Inc. – Successfully defended Halliburton against patent infringement and conversion claims brought in the District of Montana, Missoula Division related to fiber optic sensing technologies.
- Dynamic 3D Geosolutions LLC v. Halliburton Energy Services Inc., et al. – Successful defense of Halliburton in a suit alleging patent infringement related to 3-D imaging software for downhole applications.
- Deepwater Horizon Gulf Oil Spill MDL Litigation. – Represented Halliburton and Sperry Sun, with focus on defense strategy and management of all matters related to expert analysis and testimony in the MDL litigation arising out of the Deepwater Horizon oil spill in the Gulf of Mexico.
- Mary Kay v. Michael Kors. – Represented Michael Kors in trademark litigation to successful resolution with Mary Kay pending in the Northern District of Texas.
- Represented a private equity firm and related interests in state court litigation arising out of an acquisition of assets.
- Boulle Ltd. v. De Boulle Diamond & Jewelry Inc. – Represented luxury jeweler in trademark litigation in the Northern District of Texas.
- Behind the Chair.com, Inc. v. Dean Christal, Olaplex LLC, and Does 1-10 – Represented Olaplex and related entities in defense of multiple claims in California state court arising out of a business dispute related to equity interests in patented hair care technology.
- Successful representation of private equity firm and affiliated entities in litigation related to executive compensation and equity.
- Coding Technologies v. Halliburton Energy Services, Inc. – Obtained successful dismissal of patent infringement suit brought alleging infringement of method patent covering use of QR code patterns filed in the Eastern District of Texas.
- Weatherford International Inc. and Weatherford/Lamb Inc. v. Halliburton and General Plastics & Composites L.P. – Represented Halliburton and General Plastics through final pretrial preparations in patent suit in the Eastern District of Texas (Marshall Division) related to a method of forming composite parts for use in downhole tools, such as frac plugs, bridge plugs, and packers.
- MCR Oil Tools v. Halliburton. – Represented Halliburton in commercial litigation filed in state court related to contractual rights to radial cutting torch technology.
- Bjorn Myklatun and Oil Innovation v. Halliburton Energy Services et al. – Represented Halliburton in commercial litigation in the Western District of Oklahoma related to the joint development of microemulsions.
- Aloft Media LLC v. Oracle Corporation, et al. – Successfully represented Halliburton to obtain dismissal of patent litigation in the Eastern District of Texas related to computer software.
- Realtimezone Inc. v. Halliburton Energy Services Inc. – Represented Halliburton in commercial litigation in New Mexico.
- ReedHycalog UK Ltd. v. US Synthetic Corporation and Halliburton Energy Services Inc. – Represented US Synthetic and Halliburton against patent infringement claims filed by ReedHycalog based on four patents related to leached diamond drill-bit cutting elements, in the Eastern District of Texas.
- MOSAID 802.11 Litigation. – Represented MOSAID in 802.11 Wi-Fi patent litigation.
- Halliburton v. GeoGuidance, et al. – Represented Halliburton in California trade secret litigation against GeoGuidance and former employees to favorable settlement.
- Main Hastings LLC v. Halliburton Company and Jet Research Center LLC. – Represented Halliburton in false marking patent case in the Eastern District of Texas, obtaining early case dismissal.
- Kilts Resources LLC v. Halliburton Company et al. – Represented Halliburton in patent litigation in the Eastern District of Texas.
- Dynamic 3D Geosolutions v. Halliburton Energy Services, Inc. – Successful defense of Halliburton against patent infringement claims filed in the Western District of Texas related to a geological interpretation computer system.
