Biography

MARYANNE KAMAU advises clients on international trade and EU law with a primary focus on market access and compliance risks arising from supply chain rules, sanctions and export controls, customs rules, and investment screening.

Maryanne advises on issues at the intersection of trade, sustainability, economic security and regulatory compliance in the context of cross-border transactions, commercial arrangements, and disputes.  This includes: 

  • EU supply-chain compliance regimes that condition market access, including the EU Batteries Regulation, EU Forced Labour Regulation, Carbon Border Adjustment Mechanism (CBAM), EU Deforestation Regulation and related due diligence, traceability, and sourcing requirements.
  • Sanctions and trade controls, including Russia-related sanctions, advising on the scope and application of restrictive measures and sanctions issues arising in transactions and commercial arrangements.
  • Customs and border-related issues, including how customs requirements interact with other EU regulatory obligations affecting imports into and exports from the EU.
  • Investment screening and subsidy controls reviews in the context of cross-border transactions.
  • Trade-related disputes, including commercial disputes involving sanctions and export controls and international trade disputes before the World Trade Organization (WTO). 
  • Sector-specific emissions regulation, including automotive emissions rules and sustainable aviation fuel (SAF) mandates.

Maryanne gained first-hand experience in EU policy and regulatory engagement during a client secondment to the EU public policy team of a multinational technology company.

Maryanne regularly speaks at international conferences and has published on EU and international trade law in academic journals and books.

Investment screening, trade controls, and subsidy control transactional experience, including advising:

International and trade-related dispute settlement experience, including advising:

  • Airbus, standing behind the European Union in the landmark Boeing-Airbus “large civil aircraft” subsidy disputes, which are the biggest and longest-running dispute in World Trade Organization history.
  • The African Union before the International Tribunal for the Law of the Sea in an advisory proceeding concerning climate change and its effects on the marine environment.

Pro Bono

A keen advocate, Maryanne actively participates in Sidley’s pro bono practice through the firm’s Trade for Development Initiative and Emerging Enterprises Pro Bono Program, which provide free legal support to small- and medium-size for-profit enterprises, market-focused non-governmental organizations, least developed and low-income developing countries, and trade associations, in areas related to trade and investment.
